Estate Planning in California: Safe Deposit Box

Many people utilize a safe deposit box to store valuable items. A person might keep a prized piece of jewelry, an antique watch or their passport in it. What is also commonly found in a safe deposit box is an original copy of a person's will and trust. A will and trust are one of the few legal documents where an original is generally required. I always tell clients to store their will and trust in a safe deposit box, assuming they have one, because it is a secure location.

Frequently, a person will own a safe deposit box in his or her name alone.? Since the asset is held in their name alone, there is the initial concern that access will be prohibited once they pass away. However, the probate code has been amended to allow access to the safe deposit box for specified reasons for certain people. The following explains how a person can gain to the safe deposit box and what they may remove.

First, the person seeking access must have a key to the box. Prob C ? 331(a). It is not enough if the person is a relative or friend of the decedent, he or she needs a key to gain access. Next, this person must showing the bank both of the following (Prob C ? 331(b):? ?
?

(1) Proof of the decedent?s death. Proof shall be provided by a certified copy of the decedent?s death certificate or by a written statement of death from the coroner, treating physician, or hospital or institution where the decedent died.

(2) Reasonable proof of the identity of the person seeking access. Reasonable proof of identity is provided for the purpose of this paragraph if the requirements of Section 13104 are satisfied.

In short, the person needs to show a death certificate and a driver's license to the bank.

Upon satisfaction of Prob C ? 331(b), the bank is required to do the following:

(1) Keep a record of the identity of the person.

(2) Permit the person to open the safe deposit box under the supervision of an officer or employee of the financial institution, and to make an inventory of its contents.

(3) Make a photocopy of all wills and trust instruments removed from the safe deposit box, and keep the photocopy in the safe deposit box until the contents of the box are removed by the personal representative of the estate or other legally authorized person. The financial institution may charge the person given access a reasonable fee for photocopying.

(4) Permit the person given access to remove instructions for the disposition of the decedent?s remains, and, after a photocopy is made, to remove the wills and trust instruments.

In short, the person can remove the decedent's will and trust from the safe deposit box but must make a copy of each.?

Then, the person is to deliver all wills found in the safe deposit box to the clerk of the superior court and mail or deliver a copy to the person named in the will as executor or beneficiary as provided in Section 8200. Prob C ? 331(e).

However, this person is not given carte blanche in regards to removing items. The last part of Prob C ? 331 states:

(f) Except as provided in subdivision (d), the person given access shall not remove any of the contents of the decedent?s safe deposit box.

Thus, if the safe deposit box had a large sum of cash, an Omega watch or the keys to a Ferrari in it, the person would be prohibited from taking these items. The personal representative would be the appropriate party to remove these items from the safe deposit box. A person is appointed the personal representative of a decedent's estate only after filing various documents with the probate court.

Isaac threat to Gulf Coast well beyond New Orleans

NEW ORLEANS (AP) ? With its massive size and ponderous movement, a strengthening Isaac could become a punishing rain machine depending on its power, speed and where it comes ashore along the Gulf Coast.

The focus has been on New Orleans as Isaac takes dead aim at the city seven years after Hurricane Katrina, but the impact will be felt well beyond the city limits. The storm's winds could be felt more than 200 miles from its center.

The Gulf Coast region has been saturated thanks to a wet summer, and some officials have worried more rain could make it easy for trees and power lines to fall over in the wet ground. Too much water also could flood crops, and wind could topple plants such as corn and cotton.

"A large, slow-moving system is going to pose a lot of problems: winds, flooding, storm surge and even potentially down the road river flooding," said Richard Knabb, director of the National Hurricane Center in Miami. "That could happen for days after the event."

The storm's potential for destruction was not lost on Alabama farmer Bert Driskell, who raises peanuts, cotton, wheat, cattle and sod on several thousand acres near Grand Bay, in Mobile County.

"We don't need a lot of water this close to harvest," Driskell said.

However, Isaac could bring some relief to places farther inland where farmers have struggled with drought. It also may help replenish a Mississippi River that has at times been so low that barge traffic is halted so engineers can scrape the bottom to deepen it.

Forecasters predicted Isaac would intensify into a Category 2 hurricane, with winds of about 100 mph, by early Wednesday around the time it's expected to make landfall. The current forecast track has the storm aimed at New Orleans, but hurricane warnings extended across 280 miles from Morgan City, La., to the Florida-Alabama state line. It could become the first hurricane to hit the Gulf Coast since 2008.

Evacuations were ordered for some low-lying areas and across the region, people boarded up homes, stocked up on supplies and got ready for the storm. Schools, universities and businesses closed in many places.

Still, all the preparation may not matter if flooding becomes the greatest threat. In Pascagoula, Miss., Nannette Clark was supervising a work crew installing wood coverings over windows of her more than 130-year-old home. But she said all that won't matter if a storm surge reaches her home, as it did after Katrina in 2005.

"The water was up to the first landing of the stairs," she said. "So I get very nervous about it."

Isaac's approach on the eve of the Katrina anniversary invited obvious comparisons, but Isaac is nowhere near as powerful as the Katrina was when it struck on Aug. 29, 2005. Katrina at one point reached Category 5 status with winds of over 157 mph. It made landfall as a Category 3 storm and created a huge storm surge.

Federal Emergency Management Agency officials said the updated levees around New Orleans are equipped to handle storms stronger than Isaac. Levee failures led to the catastrophic flooding in the area after Katrina.

"It's a much more robust system than what it was when Katrina came ashore," said FEMA Administrator Craig Fugate in a conference call with reporters.

In New Orleans, officials had no plans to order evacuations and instead told residents to hunker down and make do with the supplies they had.

"It's going to be all right," said New Orleans Mayor Mitch Landrieu.

Isaac could pack a watery double punch for the Gulf Coast. If it hits during high tide, Isaac could push floodwaters as deep as 12 feet onto shore in Louisiana, Mississippi and Alabama and up to 6 feet in the Florida Panhandle, while dumping up to 18 inches of rain over the region, the National Weather Service warned.

As of 8 p.m. EDT on Monday, Isaac remained a tropical storm with winds of 70 mph (110 kph). Its center was about 230 miles (370 km) southeast of the mouth of the Mississippi River, and it was moving northwest at 10 mph (17 kph).

On the Alabama coast, Billy Cannon, 72, was preparing to evacuate with several cars packed with family and four Chihuahuas from a home on a peninsula in Gulf Shores. Cannon, who has lived on the coast for 30 years, said he thinks the order to evacuate Monday was premature.

"If it comes in, it's just going to be a big rain storm. I think they overreacted, but I understand where they're coming from. It's safety," he said.

The storm left 24 dead in Haiti and the Dominican Republic, but left little damage in the Florida Keys as it blew past. It promised a soaking but little more for Tampa, where the planned Monday start of the Republican National Convention was pushed back because of the storm.

Only a fraction of an expected 5,000 demonstrators turned out in Tampa to protest GOP economic and social policies outside the convention. Organizers blamed Isaac and a massive police presence for their weak showing.

The storm had lingering effects for much of Florida, including heavy rains and isolated flooding in Miami and points north. Gov. Rick Scott said that as of Monday evening, about 80,000 customers were without power in Florida as a result of the storm.

Scott, a Republican, was returning from the convention in Tampa to Tallahassee to monitor Isaac. Fellow Gulf Coast Republican Govs. Bobby Jindal of Louisiana and Robert Bentley of Alabama said they would not attend the convention at all. Mississippi Gov. Phil Bryant delayed his travel through Wednesday, leaving open the possibility he could attend the final day of the event.

States of emergency were in effect in Louisiana, Mississippi, Alabama and Florida.

The choppy ocean waters generated by Isaac weren't all bad for everyone, though. On Pensacola Bay, fishermen boasted big hauls.

"You get a little storm headed this way and they seem to run a little. When the barometric pressure drops, something causes them to run better," said Eric Roberts, who was out fishing for mullet.

Health Insurance Can Be a Bitch | Budgets Are Sexy

Every time I think I can forget about my health insurance, something comes up and reminds me all over again how much I despise it.? I know it?s important and there?s nothing you can really do to avoid it unless you were billionaire or something, but I?m still gonna bitch and moan about it anyways cuz this is my blog and I can cry if I want to ;)

For those who were following this site this time last year, you?ll remember I waited quite a while to finally deal with it after months of being self-employed.? I had been on my wife?s University plan for the first half of the year, but mid-way through they dropped the coverage of all family members and dependents (d?oh), and I was forced to go out on my own.? In the end though it was solved pretty easily as all I did (thanks to some of your recommendations!) was hit up?eHealthInsurance.com and sort through the options available after answering a few basic questions. I poked around a bit, talked it over w/ the wife, and settled on a solid (maybe TOO solid) plan with CareFirst Blue Cross Blue Shield.

And then we had a baby ;) All great things emotionally, but not so much w/ money (as you can tell from my continuously updated Baby Money Tracker! Which will be the subject of a new post here shortly?)? And since we can?t add him to the Mrs? plan as I just mentioned, it means he had to be added to mine instead.? Which is fine in the long run since it makes things nice and easy ? and portable! ? for wherever we end up moving to and all that, but getting over the initial shock of seeing my new rates were pretty frightening? you?re about to see them below, jeez?

The crazy part too is that I RARELY even used my insurance at all last year. You wanna know the total number of times I went to see a doctor? One. That?s it. Yeah it?s good I didn?t get all that sick and end up in the hospital any time last year (really good!), and that I?m super covered for the future as well especially now that I?m a parent, but it still pains me to know I spent over $3,000 in total for one simple visit to a CVS Minute Clinic (which are GREAT btw). The whole insurance game is just crazy to me. I know we get jealous of all those countries who have ?free? universal health care, even if they?re not 100% top notch as many are quick to point out (I don?t know anything about anything, so I just stay out of the arguments), but I will say it must be nice to at least not have to worry about it all the time.? It?s there whenever you need it and it?s not changing every other month?

Anyways, as you can tell I hate dealing with health insurance.? Life insurance is fine ? you rarely have to go in and make a ton of changes, as we talked about last week during the Life Insurance Movement ? but this one just drives me bananas. And I know I?m not alone here ;0

Check out my payments over the past 10 or so years, and look how it?s starting to trend. Ugh.

  • $200/mo ? what I was paying 10? years ago at my old company
  • $150/mo ? what I was paying over the next couple of years through a different company
  • $0.00/mo ? what I was paying for at the height of the last start-up I worked for! To say we? had some pretty killer benefits would be an understatement :)
  • $280/mo ? what I ended up paying at the end of 2010 when all those benefits got cut and the company eventually went under
  • $292/mo ? what I started paying last year when I went out on my own through eHealth (I ended up picking a sturdy Blue Cross Blue Shield plan, even though there were plenty of cheaper ones)
  • $573/mo ? what the additional cost was to add Baby $ to the mix (!!!), starting last month.
  • $643/mo ? what it will cost going forward starting October 1st!? Ugh?.

A 100% increase in the past two months!!! One for the baby, and one for what I can only assume is a normal yearly adjustment? Which will now cost me an additional 75 boners every month I?m insured, freakin? crazy. And a good reminder of some of the cons of working for yourself to all you out there who?s considering the same! We enjoy a helluva lot of other great benefits like me sitting here in my boxers right now typing this (tmi?), but financially you can really get a foot up your a$$ every now and then. It?s not fun (although sometimes tax deductible).

The only thing I enjoy out of this is the fact I?m providing for my family and supporting my wee one in all future doctor visits going forward :) That does feel awesome.? And that I?m being a good dad to him right from the start ? so I can?t complain all the way. And as I already alluded to, we ALSO have a pretty damn solid plan ? the reason for such high premiums.

We have a PPO with a $600 family deductible and only 10% co-payments after that.? Along with $25 office visits, and up to a yearly max of $5,000 (total) out of our pockets. So I could easily increase the deductibles and co-payments to save a good chunk every month (roughly $100 for two levels up), but knowing how often babies go to the doctors I?m gonna lay low for a bit and see what happens. Apparently your kid gets whatever terms YOUR plan provides, so if I up all my stuff to save some money, it increases the payouts for the baby too. Which scares me to death?

Now on the PLUS side, I can add as many more babies to the plan as I want without paying a penny more! Haha? WOOT. They screw you for that 1st one, but any others after they can care less ;)? I hope they mean it cuz I?ll be gladly taking them up on that in the future! You better believe it!

Anyone else dealing with health insurance headaches?? Anyone have some awesome (or even worse) plans than myself? Someone make me feel better! Haha? just kidding :) Kinda?

NATO force: Afghan ally kills 2 coalition members

KABUL, Afghanistan (AP) ? NATO forces in Afghanistan say an Afghan soldier has turned his weapon on international troops, killing 2 coalition service members in the country's east.

Spokesman Lt. Col. Hagen Messer of Germany says the attack happened earlier Monday in Laghman province.

He declined to provide details, saying only that coalition and Afghan officials were investigating the shooting.
