Smith Moore Leatherwood Earns Top Rankings in 2011 Chambers Guide ...

Raleigh attorney recognized among state's best in labor and employment law

- Smith Moore Leatherwood attorney Jerry Oliver from the firm?s Raleigh, N.C., office has been ranked among ?Leaders in Their Field,? by Chambers and Partners, publisher of the world?s leading guides to the legal profession. The 2011 Chambers USA Guide was published earlier this month and selected Oliver among the state?s best in labor and employment law. The firm?s labor and employment practice was also recognized in the 2011 Guide as one of the best in the state.

In its 12th year of publication, Chambers USA is an annual publication ranking leading attorneys and law firms in the United States. The results are gathered through hours of research and thousands of interviews with both clients and attorneys, with greater weight given to the views of the clients. The qualities on which the rankings are assessed include technical legal ability, professional conduct, client service, commercial astuteness, diligence, commitment and other qualities most valued by the client.

?These rankings acknowledge Jerry and his efforts to build one of the most comprehensive labor and employment practices in the state,? said David Otterson, partner in charge of the firm?s Raleigh office. ?We also are delighted that our firm has been recognized for its outstanding reputation in labor and employment law.?

Firm wide, the 2011 Chambers USA Guide selected 20 Smith Moore Leatherwood attorneys from the firm?s offices in North Carolina, South Carolina and Georgia. The firm also earned recognition by the professional legal guide in seven core practice areas. These included: Corporate/Mergers and Acquisitions; Environmental Law; Health care; Labor and Employment; Litigation: General Commercial; Real Estate Law; and Real Estate: Zoning/Land Use.

George J. Oliver

Jerry Oliver has been practicing labor and employment law for more than 20 years. He counsels and represents employers in all aspects of employment law, including litigation before state and federal courts and agencies in the areas of federal and state EEOC laws, FMLA and ADA matters, wage and hour issues, personnel practices, wrongful discharge and safety matters under OSHA. His practice has a heavy emphasis on proactive counseling to assist employers in avoiding litigation and solving labor-related problems.

Oliver has represented private and public sector employers throughout the U.S. in union avoidance campaigns under both the National Labor Relations Act and the Railway Labor Act, where he assisted some of the largest employers in both the railway and airline industries. He has extensive experience in representation disputes and has assisted in decertifying unions under these Acts. He has represented employers in collective bargaining negotiations and arbitration matters in court, as well as before the National Labor Relations Board and the National Mediation Board.

Computer Phobias | Computers and Technology

Years ago about the end of January I would develop Chinophobia (fear of snow). Perhaps it was due to the fact we had three-5 feet of snow and I was ready for spring. Over the years I have developed ?temporary phobias? for a number of great reasons.

A phobia is a handy way to get myself out of unpleasant situations. I developed Dentophobia (fear of the dentist) when my wisdom teeth decided to come in, but it was cured when the pain became so unbearable that I set out for the dentist office for some relief. Phobias also offer great excuses for why I do some of the silly things I appear to do, such as, when computers had been first introduced to our school.

When computers were very first introduced to our school I developed instant Cyberphobia (fear of computers or working on them). As the years passed I lost this phobia, but I noticed that there are a lot of phobias associated with computers. In other words if you have any of the following phobias I would not be even near a personal computer.

Neophobia (fear of anything new)?computers change daily, oops, hourly so you need to have to prevent them.

Monophobia (fear of being alone)?since working on a personal computer is not group work you need to stay away from a laptop or computer.

Ballistophobia (fear of bullets)? You can get near a pc and even work on 1, but stay away from that bullet button at all costs.

Tropophobia (fear of creating modifications)?don?t even be in the vicinity of a personal computer because this is a continual procedure and if you do not alter your computer system often you swiftly revert to the caveman era of pc technology.

Atychiphobia (fear of failure) ? much better not chance using a laptop or computer because the power may fail, the lights could flicker and then your method fails and you have to start off all over. Besides that, one misplaced finger can make you wonder, ?What happened now??

Ankylophobia (fear of joint immobility) attempt sitting at a pc all day and then get up, it is close to impossible at my age so avoid the computer.

Kaniophobia (fear of anything new or novel) with a personal computer it?s usually changing and you might not be warned about those changes, so do not opportunity it.

Allodoxaphobia (fear of opinions)?you can get on the computer, but stay away from chat rooms and articles, like this, at all costs. Castisophobia (fear of sitting)?self explanatory, just steer clear of the pc.

Tachophobia (fear of speed)?avoid computers only if they have high speed world wide web and it was built last year, other wise, it is okay.

Polyphobia (fear of a lot of points)?Everything connected to the laptop or computer is numbered in the a lot of things category. Several functions, many buttons, many sights and specifically several wires.

Technophobia (fear of technology) That?s what computers are all about, technology, so prevent.

Could you locate your life free of charge of any phobias and typing peacefully on your personal computer. Have a great life.

National Parks Ailing, But a Cure Is Possible, Report Says (LiveScience.com)

A decade-long survey of National Park Service sites gives the system a grade that is, at best, mediocre, and enumerates challenges faced by national parks, including invasive species, climate change, encroaching pollution and development, and chronic underfunding.

The advocacy organization behind the report, the National Parks Conservation Association (NPCA), offers a series of solutions, including the re-introduction of native species, the reduction of threats from lands bordering parks, additional funding for and the expansion of the park service.

With the centennial anniversary of the park service five years away, in 2016, NPCA President Tom Kiernan called on the Obama administration to adopt the recommendations.

"We have five years," Kiernan said during a conference on Tuesday (June 28). "This is the time for action."

Researchers assessed conditions at 80 of the 394 national parks, starting in 2001. Sixty-six percent received "fair" rankings on the conditions of their natural resources, such as native species. Meanwhile, 91 percent had cultural resources ? such as archival collections and historic structures ? assessed as being in "fair" or "poor" condition. No site had cultural resources in "excellent" condition in the report, The State of America's National Parks. ?

Many problems don't originate within the parks' boundaries; human activity just outside the parks can affect their inhabitants, according to the report. For instance, timber clear-cutting along the boundary of Olympic National Park in Washington has turned the park into an island, interfering with species' migration and increasing erosion, which chokes out salmon and other aquatic life, it says.

The report recommends the federal government reduce threats from adjacent land and ensure that agencies manage nearby lands collaboratively. It also encourages the addition of new national parks and the expansion of existing ones.

Researchers also found success stories. A project at the Channel Islands National Park, off the coast of California, removed the livestock ? horses, rats, pigs, sheep, cows, cats, donkeys, European honeybees, and rabbits ? that had wreaked havoc on the ecosystem, and restored native grasses, foxes and bald eagles. [Top 10 Least Visited National Parks]

More money is an inevitable part of the suggestions ? according to the report, the National Park Service had a $600 million operating budget shortfall in fiscal year 2010 and it has an enormous backlog of maintenance projects. (Its 2010 budget was $3.16 billion for 21,574 employees, according to the National Park Service.)??

Kiernan acknowledged that the nation is in a difficult fiscal situation. But, he pointed out, every dollar invested in a national park returns $4 to the surrounding community, especially rural communities.

Scandalous Women: Scandalous Book Review: Before Versailles

Synopsis:?
Louis XIV is one of the best-known monarchs ever to grace the French throne. But what was he like as a young man?the man before Versailles?

After the death of his prime minister, Cardinal Mazarin, twenty-two-year-old Louis steps into governing France. He?s still a young man, but one who, as king, willfully takes everything he can get?including his brother?s wife. As the love affair between Louis and Princess Henriette burns, it sets the kingdom on the road toward unmistakable scandal and conflict with the Vatican. Every woman wants him. He must face what he is willing to sacrifice for love.

But there are other problems lurking outside the chateau of Fontainebleau: a boy in an iron mask has been seen in the woods, and the king?s finance minister, Nicolas Fouquet, has proven to be more powerful than Louis ever thought?a man who could make a great ally or become a dangerous foe . . . Meticulously researched and vividly brought to life by the gorgeous prose of Karleen Koen, Before Versailles dares to explore the forces that shaped an iconic king and determined the fate of an empire.

My thoughts:? I first read Karleen Koen's first book THROUGH A GLASS DARKLY when it first came out back in 1986, which I still have.? I think it was the first?novel that I ever bought in hardcover, with my hard-earned money from my first grown-up job.? I remember loving the rich detail of the book, although I was furious with several of the main characters for what I thought was their mistreatment of the heroine, Barbara. I read her other two books, but it's been a long wait for her new one.

Koen's new book, BEFORE VERSAILLES,? is released in bookstores today and it was well worth the wait. It is a sumptuous confection of a novel?filled with rich details of the court of the young Louis XIV.? Koen focuses on a four months in Louis' life when the reader gets a glimpse of what he was like before he became the powerful, absolute monarch who became known as the Sun King.? This Louis is still finding his feet as King after the death of his mentor (and possibly his mother's lover) Cardinal Mazarin who had guided Louis from his childhood. Now Louis must learn who he can trust and who he can't, who has his best interests and those of France at heart, and those who seek solely to enrich to themselves.? He also has to contend with his younger brother Philippe who alternates between hero-worship and resentment, and his burgeoning, illicit love for his cousin and sister-in-law Henriette also known as Madame.

I have always had a bit of a crush on the royal cousins, Louis XIV and Charles II, particularly in the early years of their reign, so I was interested to hear at the Historical Novel Society conference that this was the first time that Koen had featured a real life historical person at the center of her book, and it is easy to see why Louis grabbed her imagination, and why this particular period in time.? This Louis alternates between confidence in his own abilities and seeking the wisdom of others. It is fascinating to watch him grow over the course of the novel as he realizes his own strengths as a monarch. There was a part of me as I was reading the book that wished that Minette (Henriette) and Louis could have had their happy ending (I've always felt this way) but the Minette in Koen's hands, while she loves the King is torn between that love, and realizing that as a woman, she has much farther to fall than her beloved. Anne of Austria, in?Koen's hands, is woman who is tired after years of trying to hold onto power and to the kingdom for her son, but still wily and manipulative when she needs to be. It's such a contrast to the Anne that Dumas portrays in The Three Muskateers. I would love to see how Koen would treat the earlier Anne in the court of Louis XIII, who comes across as a 17th century version of Richard Nixon.

Koen is such a skilled storyteller that I have the time I was in awe while I was reading the book, the way she weaves the story of the Man in the Iron Mask, which the court intrigues, and the human drama, made me want to genuflect at her feet. Not once I was?I lost or confused in the maze of characters that populate the court at Fontainebleau. Her ability to make such a vast group of inviduals come alive, and to get into each characters head?is truly remarkable. From La Grande Mademoiselle down to the musketeer Cinq Mars, the reader knows exactly who they are, what they stand for and what they feel at any given moment. Louise de la Valliere, who I've normally thought of as the least interesting of the Sun King's many mistresses, comes alive in this novel. She manages to hold onto her moral compass while everyone around is losing theirs, as they jockey for position at court. Her innocence and naivete aren't cloying in Koen's hands. Minette, on the other, comes across at times as drunk on her own power over Louis, less in love with him and more in love with the idea of her power over him, which seems like a fresh approach. She's always been one of my favorite historical figures, but I've always found it her one of the saddest. It's understandable after years of being the poor, orphaned princess without a father or a country that she would revel a bit in her power. Koen comes up with a plausible interpretation of the myth of The Man in the Iron Mask which makes more sense than the one that Dumas came up with in his novel of the same name.

Her prose is stunning and evocative.? This is what Louis thinks about the Viscomte Nicholas Fouquet, "He was going to have to break the Viscount in half and hold the pieces up like trophies to paralyze his court with aw and under the awe, real fear." I couldn't put this book down and when it was over I wanted more, which is the sign of an amazing storyteller.

Leadership Training for Your Boss ? The Free Articles Directory

Is there any other person in the corporation who plays the biggest and most difficult part than the CEO? Well, I suspect we know the response there. That is precisely why each CEO of a organisation- large or small- must go through leadership trainingconventions to do their job as best possible.

A leadership training seminar is a great way for Bosses to keep their command abilities and styles as current as possible. Times are changing- at fast speed, at that.

In its most elementary sense, training is where a person gains information and talents as a result of learning from a pro or an expert.

Leadership is defined as the method of social influence in which one person can enroll the aid and support of other people in the accomplishment of a typical job.

As you probably know, running a organisation is not a a walk in the park so you need to be sure that you get data that should be backed by facts and real world experience and scientific research.

Your leadership training course must be concentrated on helping you procure new management, leadership and entrepreneurial talents. You have to be as updated as possible. The sole way you can stay alongside of your competition is through always being in the loop as to Whats New? in the industry.

Another major factor to have a look for when looking for a leadership training is its focus on developing or getting a grip on great people skills. Leadership is all about effectively relating or influencing other people.

The thing is, the only way to achieve great leadership if you know how to cope with people. A organisation is always as good as its folk and you have to keep that under consideration.

In every leadership training, you should always expect to learn new abilities that will help you to learn to address other people the best way. You see, the key to any successful business has everybody in the organisation in the same page. It is vital that each worker in your business shares the same goal as you. And this will only be attained if you boost the best people skills.

Research has demonstrated that 80% of a organisations success is determined by how you lead a team on an everyday basis. There?s a business psychology that must be applied and this is a thing you should expect to learn in your leadership training.

Ive been asked many times before why I think a leadership training or seminar is significant. Well, I think we could best answer that by deciding upon what leadership truly is.

Leadership is so very much more than just making choices, implementing them and ensuring everyone follows them. And its definitely not about being the manager and making orders left and right. Leadership is being in control of a group of people, looking after them and making sure that you lead them to the path of success.

Week-in-review | Since My Divorce ?divorce support for women ...

It is officially summer. That means my ex and I, like many other divorced couples, have a different parenting schedule. During the summer we?re supposed to alternate weeks. I say supposed to because we aren?t. We don?t even have a schedule worked out. Part of that is because my son has been away for two separate weeks already and in just over two weeks, the kids and I are leaving for our trip. For the most part, the kids are at my house but on any given evening, one or both of them might announce they?re going to dad?s. And that?s OK with me.

I think this is a sign of how far we?ve come in our post-divorce relationship that we can be flexible over our parenting schedule. We know neither one of us is going to try to monopolize the kids, or try to influence the kids against spending time with the other parent. I think we trust each other and that?s feels good.

My ex is a teacher and since our schools are not on a year-round schedule, it means he has more free time than I do now. So I?ve been looking for ways he can help out more. For example, my son is learning to drive and he really needs to be out driving every day, just getting the practice. Getting my ex to take him out is a win-win-win ? my ex is happy to take my son driving, my son wants to drive and I don?t have the time to take my son driving as much as I think he needs.

My ex is also a shopper. I am not. Since our divorce, I am a much more intentional shopper but I don?t have anywhere near the patience or stamina for shopping that he has. So this week, when my computer techie* delivered the news that my son?s four-year-old laptop wasn?t worth working on and should be retired, I enlisted my ex?s help,

Do you have time and would you like to go buy a new laptop?

Sure! I was ninety-nine percent certain he wouldn?t say no, given that he is a technology education teacher and loves to shop. Did I say that already?

My computer techie suggested the specs for a new machine and off my ex and son went. First stop, Staples where the saleslady tried to tell him the machine he was going to buy had a bad rap and that he should buy a service agreement that cost more than the machine. That didn?t make much sense.

Next stop, Office Depot where this particular machine was more expensive than the Staples price so they agreed to match the price and then there was a $50 mail-in rebate, in addition. Score one laptop for $300 and another win-win-win!

It?s been over four and a half years since we separated ? I don?t think I was so willing to enlist his help back then. I think I was intent on proving that I was capable of doing it all.? It feels good to know now I don?t have to do it all.

*I learned very early on that every single-woman needs a good handyman. I also think your support network needs to include a good computer guru ? I?m happy to ask my ex for help with the kids machines but I need someone else to work on my machine.

From around the web

From April at All About Balance ? I loved this post about Zillow?s best places in America for single moms ? I?m with April ? the best place is where you feel you can thrive. In some respects, April is fortunate: she has full legal custody of her children and her ex is essentially uninvolved. That means she was free to move cross-country to L.A. where she has the support of her family. Not everyone has the freedom to move like that and that means doing your best to thrive where you are.

From Laura Campbell at the Huffington Post ? How Could I Do That? And Other Ways we are our Own Worst Enemy -? on how divorce opened her eyes to herself and started her education in life.

From Deborah Moskovitch at the Huffington Post ? How You Can Forgive Your Ex-Spouse ? on why it?s important for your own health to forgive.

A Reader Request

Do any of you know of a wall calendar for children aged nine and twelve, that could be used to show their parenting schedule? What are you using?

My kids were older when we separated ? eleven and fourteen and since we were on an every other weekend schedule, I think it was pretty straight forward for them but I can definitely see where something bright and colorful could help younger children settle into a new routine.

This weekend, my daughter and I are shopping for college dorm needs. I?m feeling very conflicted about this ? I?m happy she wants me to come with her but I dread the thought of getting dragged round store after store after store; my ex would probably like to do this but the combination of my daughter, my ex and this shopping just spells disaster. However, with temperatures forecasted for the low nineties, at least if I?m shopping I?ll be in air-conditioning. I guess I can be thankful for that.

Wish me luck!

Green Computing solutions ? ArticleExpert.net

Green computing means efficient use of resources in computing. Green Computers is one of the best solution to create an environmentally friendly working experience for users. Green Computing smartly uses all electronic resources and bringing conservation into every task. The ever-changing pace of technology is good news for gadget lovers, but not such good news for the environment. As the use electronic devices is increasing day by day, the electronic waste containing harmful chemicals which cannot be disposed off safely is a matter of concern. Green Computing is the solution for this growing concern.

How to do Green Computing

1. Switching off the desktop monitor when it is not being used. Despite the debate over whether it?s better for your computer to be left on or shut off, the fact is it?s better for the environment to shut it off.
2. By using new energy saving LCDs instead of traditional CRT desktop monitors.
3. By using new energy saving and efficient cooling systems like liquid computer cooling systems in place of old heat sinks.
4. Temperature maintenance and regulation to reduce thermal shock wear and tear to computer parts.
5. Increased online security measures through the use of firewalls, anti spyware and anti virus software to reduce the ever increasing levels of e-waste on the net.
6. Instead of spending more time on computers in office, one should consider reducing the computer time in your office. This will improve cathode ray tube screen visibility syndrome as well as it will save more energy.
7. Individual Green Computing involves power management by individual users. It also involves cutting off power supply to computer peripherals like scanners and printers.
8. Buy Energy Star labeled monitors, desktop, laptops, and printers . The ?Energy Star? computer devices can be programmed to ?power-down? to a low power state when they are not being used, helping you save energy and run cooler which helps them last even longer.
9. Buy the new ?Smart Strip? power strip. The Smart Strip actually senses how much power your computer devices use and when Smart Strip senses that you have switched off, it automatically shuts off your peripherals.
10. Put laptops in ?sleep? mode when not being used. The EPA has estimated that this reduces their energy use by 60 to 70 percent.
Green Computing also involves disposal of old hardware responsibly. Consumer electronic devices contain toxic materials which can seep into the ground if not dumped properly.

Benefits of Green Computing

Save environment for the new generations.
Increase in Bottomlines and reduction in Expenses.
Reduction in the Capital Expenses of the firm.
Positive impact on the Health of Employees in the long run.

Virtualization: The way to Go Green Computing

Computer Virtualization means abstraction of computer devices, such as the process of running two or more logical computers on one set of physical hardware. In virtualization process, a system administrator can combine several physical computer systems into virtual machines on one single, powerful system, thereby reducing power and usage of cooling. In the longer run, more profits and less expenses.

Thus Green Computing is a continuous process of reducing the number of computer hardware devices and replacing them with Green Computer systems, reducing not only energy expenses but also carbon dioxide emissions and thereby saving energy.

Green Computing is the ultimate thing for the future generation of computers. Go Green Computing and contribute your share in saving the environment. Find more Go Green articles and concepts at letlifegogreen.com

E-book Edition of Novel Harry Potter

If you book mania especially novel harry potter fans, this good news you. The novelist, J.K. Rowling, announced the site pottermore.com will sell officially e-book edition of the novel ?Harry Potter?.

As quoted by news agency Associated Press (AP), J.K. Rowling has revealed about the special relationship with fans online. ?I think this is a unique and fantastic experience,? said Rowling.

Harry Potter novels are experiencing stagnant sales after the last series was released four years ago. Therefore, the publisher is optimistic, e-book edition will be welcomed warmly in the digital marketplace as well as in traditional paper versions.

Even so, the existence of the Harry Potter e-book raises concerns among traditional book store owner. The reason for this novel ?Harry Potter? became a magnet for young readers to come into their stores.

?If someone sells his own book, I could understand it. But it is a little surprising to me that the publisher will cut us out of circulation. It made us tough,? said manager Hicklebee Children?s Bookstore, Ann Seaton.

A beta version of the site will be launched on July 31, 2011, along with Harry Potter birthday.
